These Terms of Use (the "Terms") set out the conditions for using nemi (the "Service"). By using the Service, the user is deemed to have agreed to these Terms.

1. Conditions of use

The Service is intended for individuals aged 13 and over.
When creating an account, the user must provide accurate information about themselves.
Where misuse of an account is confirmed, access may be suspended.

2. Nature of the Service

The Service provides cosmetic ingredient information and safety scores as reference information, evaluated from an independent standpoint based on publicly available safety data and research.

The Service is not a medical service. Scores and explanations do not diagnose, treat, or prevent any skin condition or health concern, and are not a substitute for professional advice from a physician or pharmacist. In the case of a skin problem, please consult a medical institution.

3. Paid plan

The paid plan, "nemi Pro," is provided as an auto-renewing subscription through an Apple ID.
The price is ¥500 per month (incl. tax) or ¥4,000 per year (incl. tax). Payment is taken at purchase and again upon each automatic renewal.
Cancellation may be made through the App Store management screen. If not cancelled at least 24 hours before the next renewal date, the subscription renews automatically.
Deleting your account and cancelling your paid plan are separate actions. Removing your account from the Settings screen does not automatically cancel your App Store subscription. To stop further charges, cancel the subscription separately from the App Store management screen.
Except where required by law, refunds for periods already used are not provided; refunds follow App Store policy.
No free trial is offered at present. Should one be offered, it will be announced in advance.

4. AI-generated content

Ingredient explanations, research notes, and the reasoning behind skin-fit verdicts are generated using generative AI. See the AI usage section for details.

AI-generated content is not a medical service and cannot be used for diagnosis, treatment, or prevention. It may occasionally contain errors, so please consult multiple sources for important decisions and, as stated in Section 2, consult a physician or pharmacist for skin issues, use during pregnancy, allergies, and similar concerns.

5. Prohibited conduct

Reverse engineering, scraping, or automated bulk access of the Service.
Reselling information obtained from the Service to third parties for commercial purposes.
Using the Service's generated content (ingredient explanations, research notes, scores, etc.) to train AI/ML models without prior consent.
Infringing the rights of other users or third parties.
Conduct contrary to law or public order, or that interferes with operations.

6. Intellectual property

Intellectual property rights in the Service's software, design, logo, evaluation system, and written explanations belong to the operating team or rightful owners. The user may use the Service within the scope of personal use, but may not reproduce, modify, or redistribute it without permission.

7. Disclaimer

Product and ingredient information may differ from actual contents due to product reformulation or regulatory changes. For final decisions, please confirm the product packaging and the brand's official information.
Ingredient evaluations are independent reference information based on publicly available safety data, and do not guarantee or deny the quality, safety, or efficacy of any particular product.
To the maximum extent permitted by law, the operating team is not liable for damages arising from use of the Service. Temporary suspensions of use may occur due to maintenance and similar reasons.

8. Changes to the Terms

Where a significant change is made, it will be announced in advance in the app and on this page. Continued use of the Service after a change constitutes acceptance of the revised Terms.

9. Governing law and jurisdiction

These Terms are governed by Japanese law. In the event of a dispute relating to the Service, the Tokyo District Court shall be the court of exclusive agreed jurisdiction in the first instance. The Service is operated with regard to the Pharmaceuticals and Medical Devices Act, the Premium Display Act, and other applicable laws.
